These Terms of Service (“Terms”) govern your use of alertplumber.com (the “Service”), operated by AlertPlumber. By accessing or using the Service or submitting a callback request, you agree to these Terms.
1. About the Service
AlertPlumber is a referral service and is not a licensed contractor. All work is performed by independently-vetted contractors routed through the eLocal partner network. AlertPlumber does not perform, supervise, or guarantee any work.
AlertPlumber operates as a referral service that matches US homeowners with independently licensed plumbers in their geographic area. AlertPlumber maintains the website, the matching system, and the directory of verified plumbers, but AlertPlumber does not employ plumbers, dispatch trucks, hold contractor licenses, or perform plumbing work itself.
2. How matching works
When you submit a callback request, the request is routed to one or more verified plumbers serving your ZIP code. The matched plumber is responsible for contacting you, providing estimates, performing any work, and handling all aspects of your service relationship. Your contractual relationship for any plumbing work is between you and the matched plumber, not between you and AlertPlumber.
3. Plumber qualifications
AlertPlumber verifies plumbers against state contractor license boards (e.g., CSLB in California, TSBPE in Texas, AZ ROC in Arizona, DBPR in Florida, NSCB in Nevada) before adding them to the network. Verification is performed periodically. AlertPlumber does not warrant that a license remains in good standing between verification cycles. Before scheduling significant work, you may independently verify the plumber’s license number with your state board.
4. No warranty on plumbing services
AlertPlumber does not perform, supervise, inspect, or guarantee any plumbing work. Cost ranges, average response times, and other estimates published on the Service are based on aggregate data (BuildZoom permits, BLS wage statistics, USGS, EPA, NOAA, EIA, and Census sources cited on the methodology page) and do not constitute a quote, promise, or contract for any specific job. Actual costs vary by scope, materials, access, city restoration requirements, and other factors specific to your home.
Plumbers in the AlertPlumber network are independent contractors. AlertPlumber is not liable for the acts, omissions, work product, or business practices of any plumber. Disputes about workmanship, pricing, scheduling, or other service matters should be addressed directly with the plumber and, if unresolved, with the appropriate state contractor licensing board.
5. Acceptable use
You agree NOT to:
- Submit false, misleading, or fraudulent information through any AlertPlumber form.
- Submit a callback request on behalf of someone else without their consent.
- Use the Service to harass, defame, or harm any plumber or AlertPlumber.
- Attempt to access non-public portions of the Service, scrape data programmatically without permission, or interfere with security mechanisms (hCaptcha, rate limits, etc.).
- Use the Service to generate unsolicited communications.
6. Intellectual property
The Service, including all text, graphics, logos, icons, images, data compilations, software, and design elements, is owned by AlertPlumber or its licensors and protected by US and international copyright, trademark, and other intellectual property laws. You may view content for personal, non-commercial use. Republication, scraping, or commercial use requires written permission.
Citations to third-party sources (USGS, EPA, NOAA, BLS, state contractor boards, etc.) link to those sources directly; the underlying data belongs to those publishers.
7. User content
Information you submit through forms (callback request, contact email) is governed by the Privacy Policy. By submitting, you grant AlertPlumber a limited right to use that information to provide the matching service and to fulfill legal obligations (e.g., TCPA recordkeeping).
8. Links to third-party sites
The Service contains citations and links to third-party websites (government, industry, and commercial sources). AlertPlumber does not endorse and is not responsible for the content, policies, or practices of any third-party site.
9. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or uninterrupted availability. AlertPlumber does not warrant that any specific plumber will accept your request, respond within any specific time, or be available in your area.
10. Limitation of liability
To the maximum extent permitted by law, AlertPlumber is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to your use of the Service or any plumbing work performed by a matched plumber. AlertPlumber’s total aggregate liability for any direct damages is limited to the amount you paid AlertPlumber (which is zero, since the Service is free for homeowners) or one hundred US dollars, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless AlertPlumber, its operators, agents, and affiliates from any third-party claim arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
12. Governing law & disputes
These Terms are governed by the laws of the United States and the state in which the operator of AlertPlumber is domiciled, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be brought in the state or federal courts of that jurisdiction, and you consent to personal jurisdiction in those courts.
Disputes about plumbing work performed by an independent plumber are between you and that plumber, not AlertPlumber. AlertPlumber may assist with documentation but is not a party to the work contract.
13. Changes to these Terms
AlertPlumber may update these Terms at any time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, by a banner notice on the homepage. Continued use of the Service after the effective date of an update constitutes acceptance.
14. Severability & entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and TCPA Consent disclosure, constitute the entire agreement between you and AlertPlumber regarding use of the Service.
